1. Introduction

These Terms of Service govern access to and use of https://daialog.io and related services. By accessing or using the services, you agree to be bound by these terms. If you do not agree, you may not use the services.

2. Definitions

  • Candidate: A job seeker using the services to submit video-based applications.
  • Client: An individual or entity posting jobs and evaluating candidates.
  • Content: Any information uploaded or transmitted through the services.
  • Account: A registered user profile on Daialog.io.
Section 03

3. Eligibility and Account Registration

Clients must be 18 or older and provide accurate, current information. Anyone registering on behalf of a company must have authority to bind that company. Users are responsible for securing account credentials and notifying Daialog of unauthorized access. All users must comply with applicable laws and Daialog policies.

4. Description of Services

  • Candidates can submit structured video responses.
  • Clients can create job postings and evaluate responses.
  • Daialog provides AI-powered transcription and candidate analysis.

Daialog is not an employer or recruiter, does not make hiring decisions, and does not guarantee hiring outcomes.

5. Acceptable Use

  • Do not submit fraudulent or misleading content.
  • Do not harass or harm others.
  • Do not upload illegal or offensive materials.
  • Do not reverse-engineer or exploit the platform.
  • Do not harvest data without consent.

Violations may result in suspension, termination, and legal action.

Section 06

6. Content Ownership and License

  • Candidate content: You retain ownership of your content, but grant Daialog a license to use, process, and share it as needed to operate the platform. Employers may retain submissions for compliance purposes.
  • Daialog content: Platform materials, including logos, trademarks, and copyrights, belong to Daialog and may not be copied or modified without written permission.

7. Privacy and Data Protection

Use of the services is also subject to Daialog's Privacy Policy, including data collection, retention, usage practices, AI-based transcription and analysis, and rights under applicable privacy laws.

8. Third-Party Services

Daialog may integrate with or link to third-party services. Daialog does not control or endorse those services. Review their terms and privacy policies before use.

9. Fees, Payments, and Subscriptions

Some features require payment. Payments are handled by third-party processors and are non-refundable except where required by law.

Annual Plan Commitment Notice

Annual plans require a 12-month payment commitment. Even when billed monthly, you agree to pay for the full year. Early cancellation does not remove the remaining payment obligation.

  • Monthly - no contract: Billed monthly at the checkout rate and cancellable at any time.
  • Annual - paid monthly: Billed monthly for 12 months at a discounted annual-commitment rate. Early cancellation leaves the remaining balance due.
  • Annual - paid upfront: Billed once annually for 12 months at a discounted annual-commitment rate.
  • Pricing tiers: Plans may have different prices based on company size, employee count, or other criteria shown at checkout.

10. Disclaimers and Limitations of Liability

The services are provided "as is." Daialog does not guarantee hiring results and is not liable for employer behavior or employment-related decisions.

Section 11

11. Indemnification

Users agree to indemnify Daialog against claims arising from misuse of the services, violation of these terms, infringement of third-party rights, or employment actions connected to the platform.

Section 12

12. Termination

Daialog may suspend or terminate accounts for violations. Clients may request termination by contacting info@daialog.io. Termination of annual plans does not remove payment obligations for the remaining term.

Section 13

13. Dispute Resolution

These terms are governed by the laws of Delaware, USA. Disputes will be resolved through mediation or in Delaware courts. Each party bears its own legal fees unless applicable law requires otherwise.

14. Modifications to These Terms

Daialog may update these terms at any time by posting revisions on the website. Continued use of the services indicates acceptance of the updated terms.

15. Compliance and Legal Responsibilities

Daialog supports inclusive hiring but is not responsible for ADA compliance in hiring decisions. Employers remain responsible for providing accommodations. Questions can be sent to info@daialog.io.
